By accessing or using the Site, or by contacting us to discuss or engage services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Site.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not:
- Violate any applicable law or regulation;
- Infringe the rights of any third party;
- Interfere with or disrupt the operation of the Site;
- Attempt to gain unauthorised access to any part of the Site or related systems.
3. No Guarantee of Engagement
Contacting us through the Site, email, or any form does not automatically create a client relationship or guarantee availability. A formal engagement begins only when we mutually agree on scope, pricing, and timing, typically via a written proposal, quote, or contract confirmation.
4. Intellectual Property
All content on the Site, including text, graphics, logos, layouts, and visual designs, is owned by or licensed to The Figma Lab and is protected by applicable intellectual property laws.
You agree not to:
- Copy, reproduce, or redistribute Site content without our prior written consent;
- Misrepresent our work, brand, or materials as your own;
- Use any of our materials in a way that could harm our reputation or business.
For client projects, ownership and usage rights are defined in each separate agreement or proposal. Generally, full usage rights are transferred once all agreed fees have been paid.
5. Pricing, Invoices, and Payments
All pricing, payment schedules, and deliverables are defined individually for each project. Unless stated otherwise, invoices are payable within the timeframe indicated on the invoice.
We operate under Maltese jurisdiction as a sole proprietorship. Where applicable, invoices may include VAT under the number MT32058305.
In case of late payment, we reserve the right to pause work, delay delivery, or apply late fees, as defined in the relevant proposal or invoice terms.
6. Third-Party Services
The Site may integrate or reference third-party tools and services (such as analytics providers, hosting services, embedded forms, or animation libraries). These third parties operate under their own terms and policies.
We are not responsible for any issues, downtime, or data processing carried out directly by those third-party services.
7. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will be error-free, uninterrupted, or secure at all times.
While we strive to produce high-quality work and maintain strong performance outcomes, specific results (such as revenue, traffic, or conversion rate improvements) can never be guaranteed and depend on many factors beyond our control.
8. Limitation of Liability
To the maximum extent permitted by law, The Figma Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or revenue arising out of your use of the Site or our services.
In any case, our total liability for any claims relating to the Site or our services is limited to the total amount you have paid to us for the specific project or service giving rise to the claim.
